DISTANCE SALES AGREEMENT

BUYER

The individual or legal entity placing an order electronically through the website.

The Seller and the Buyer will be referred to together as the “Parties”.

2. SUBJECT OF THE AGREEMENT

The subject of this agreement is to set out the rights and obligations of the Parties, under Turkish Consumer Protection Law No. 6502 and the Distance Contracts Regulation, regarding the sale and delivery of the products, with their stated features and sale prices, that the Buyer orders electronically through the Seller's website www.denizsanat.com.

3. PRODUCT INFORMATION

The products':

  • Type

  • Name

  • Quantity

  • Unit price

  • Total sale price including VAT

are as stated in the order summary approved by the Buyer when ordering.

4. PAYMENT AND INVOICING

4.1. Payments are taken securely by credit/debit card through the infrastructure of iyzi Ödeme ve Elektronik Para Hizmetleri A.Ş. (iyzico). Payment may also be made by credit card, debit card, bank transfer/EFT or other methods offered by the Seller.

4.2. The Seller never stores or views the Buyer's card details during payment.

4.3. The invoice is issued electronically or in print according to the billing details provided by the Buyer when ordering.

5. DELIVERY

5.1. The product is shipped within the period stated by the Seller after order confirmation, not exceeding the legal limit of 30 days.

5.2. Delivery is made to the address provided by the Buyer when ordering.

5.3. The Seller cannot be held responsible for delays caused by the shipping company.

6. RIGHT OF WITHDRAWAL (READY-MADE PRODUCTS)

6.1. For ready-made products sold with the standard options on the site (e.g. filament colour) and containing no personalisation, the Buyer may exercise the right of withdrawal within 14 (fourteen) days of receiving the product, without giving any reason.

6.2. To withdraw, it is sufficient to send an email to info@denizsanat.com or a WhatsApp message to +90 506 661 3999 within this period.

6.3. The product must be returned unused, undamaged and in resalable condition, preferably in its original packaging. The Buyer is responsible for any loss in value caused by handling beyond normal use.

6.4. Return shipping costs are borne by the Seller. Before sending the product, the Buyer contacts the Seller to receive the return shipping details.

7. PRODUCTS EXEMPT FROM THE RIGHT OF WITHDRAWAL (PERSONALISED PRODUCTS)

7.1. Under Article 15/1-ç of the Distance Contracts Regulation, there is no right of withdrawal for the following products:

  • Products processed with a photo, name, logo, text or design sent by the Buyer

  • Products specially made at the Buyer’s request outside the standard options offered on the site (size, colour, model, etc.)

7.2. Once production of these products has started, they cannot be cancelled, returned or refunded. The Buyer declares that they knew and accepted this before placing the order.

8. DEFECTIVE PRODUCTS AND REFUNDS

8.1. For defective, damaged or wrongly sent products, the provisions on defective goods apply regardless of the product type. The Buyer notifies the Seller with a photo or video, preferably within 3 days of delivery and without using the product; if the package arrives damaged, a damage report is drawn up with the courier. If the fault lies with the Seller, the product is remade free of charge, replaced or refunded, and the shipping cost is borne by the Seller. The Buyer’s statutory rights regarding defective goods are reserved.

8.2. The product price is refunded by the original payment method within 14 days at the latest of the withdrawal notice or the accepted return request reaching the Seller. For bank transfer/EFT payments, the refund is made to the IBAN provided by the Buyer.

8.3. iyzico is only a payment intermediary; the refund process is carried out with the Seller’s approval.

9. RESPONSIBILITIES

9.1. The Seller is responsible for delivering the product free of defects and in line with the specifications in the order.

9.2. iyzico bears no responsibility for the delivery, defects or return of the product.

10. PERSONAL DATA

The Buyer's personal data is processed for:

  • Receiving the order

  • Processing the payment

  • Delivering the product

in accordance with Turkish Personal Data Protection Law No. 6698 (KVKK).

11. COMPETENT AUTHORITY

Consumer Arbitration Committees and Consumer Courts are competent for disputes arising from this agreement.

12. ENTRY INTO FORCE

By placing an order on the website, the Buyer declares that they have read, understood and accepted all provisions of this agreement.

4. NATURE OF THE PRODUCTS (VERY IMPORTANT)

Two types of products are offered on the site:

  • Ready-made products: products sold with the standard options on the site (e.g. filament colour) and containing no personalisation.

  • Personalised products: products processed with a photo, name, logo, text or design sent by the Buyer, or specially made at the Buyer’s request outside the standard options (size, colour, model, etc.).

Products whose product page asks for personalisation (a photo or text) are personalised products.

5. INFORMATION ON THE RIGHT OF WITHDRAWAL

IMPORTANT NOTICE

For ready-made products, the Buyer may exercise the right of withdrawal within 14 (fourteen) days of delivery without giving any reason. An email to info@denizsanat.com or a WhatsApp message to +90 506 661 3999 is sufficient. The product must be unused and in resalable condition. Return shipping costs are borne by the Seller. The price is refunded by the original payment method within 14 days at the latest of the notice reaching the Seller.

Under Turkish Consumer Protection Law No. 6502 and Article 15/1-ç of the Distance Contracts Regulation, there is NO RIGHT OF WITHDRAWAL for personalised products. Once production has started, these products cannot be cancelled, returned or refunded.

The Buyer declares that they clearly knew and accepted this before placing the order.

6. DEFECTIVE OR DAMAGED PRODUCTS

If the product is delivered broken, damaged or defective, if a wrong product is sent, or if it is made contrary to the order, the provisions on defective goods apply regardless of the product type. The Buyer contacts the Seller with a photo or video, preferably within 3 days of delivery and without using the product; if the package arrives damaged, a damage report is drawn up with the courier. If the fault lies with the Seller, the product is remade free of charge, replaced or refunded, and the shipping cost is borne by the Seller. The Buyer’s statutory rights regarding defective goods are reserved.

7. PAYMENT INFORMATION

  • Bank transfer / EFT / FAST

The Seller never stores or views the Buyer's card details during payment.

8. SPECIAL PROVISION FOR BANK TRANSFER / EFT PAYMENTS

For payments made by bank transfer/EFT, the order is confirmed and production begins once the payment reaches the Seller’s bank account.

From this stage, orders for personalised products cannot be cancelled or refunded; the right of withdrawal for ready-made products is reserved.

9. DELIVERY INFORMATION

  • Products are shipped within the period stated by the Seller, not exceeding the legal limit of 30 days.

  • Delivery is made to the address provided by the Buyer when ordering.

  • The Seller is not responsible for delays caused by the shipping company.

10. DISPUTE RESOLUTION

For disputes arising from this Preliminary Information Form, the competent bodies are:

  • Consumer Arbitration Committees

  • Consumer Courts

(as provided by law).

11. DECLARATION OF APPROVAL

The Buyer accepts that they have read, understood and electronically approved:

✓ the Preliminary Information Form

✓ the Distance Sales Agreement

✓ that there is no right of withdrawal for personalised products and that ready-made products carry a 14-day right of withdrawal

CANCELLATION AND RETURN POLICY

1. GENERAL INFORMATION

Two types of products are sold at Deniz Sanat:

  • Ready-made products: products sold with the standard options on the site (e.g. filament colour) and containing no personalisation.

  • Personalised products: products processed with a photo, name, logo, text or design, or made on request outside the standard options (size, colour, model, etc.).

We recommend reviewing the information on the product page before ordering.

 

2. RIGHT OF WITHDRAWAL AND RETURN CONDITIONS

14-DAY RETURNS FOR READY-MADE PRODUCTS

  • You may return ready-made products within 14 days of delivery without giving a reason.

  • An email to info@denizsanat.com or a WhatsApp message to +90 506 661 3999 is enough to notify us.

  • The product must be unused, undamaged and in resalable condition, preferably in its original packaging.

  • Deniz Sanat covers the return shipping cost. Please contact us before sending the product to receive the return shipping details.

NO RETURNS FOR PERSONALISED PRODUCTS

Under Turkish Consumer Protection Law No. 6502 and Article 15/1-ç of the Distance Contracts Regulation, there is no right of withdrawal for personalised products. Once production has started, they cannot be cancelled, returned or refunded, whether or not they have been shipped.

 

3. CANCELLATION FOR BANK TRANSFER / EFT PAYMENTS

For payments by bank transfer / EFT / FAST, the order is confirmed and production begins once the payment reaches the Seller’s account. From this stage, orders for personalised products cannot be cancelled or refunded; the 14-day right of withdrawal for ready-made products is reserved.

 

4. DEFECTIVE AND FAULTY PRODUCTS

In the following cases, the provisions on defective goods apply regardless of the product type:

  • The product is delivered broken, damaged or defective

  • The product is made contrary to the order (wrong name, wrong design, etc.)

  • A wrong product is sent

In these cases, contact us with a photo or video showing the damage, preferably within 3 days of delivery and without using the product. If the review shows the fault is ours, the product is remade free of charge, replaced or refunded, and Deniz Sanat covers the shipping cost. Your statutory rights regarding defective goods are reserved.

 

5. SHIPPING DAMAGE

For damage that occurs during shipping, a damage report must be drawn up with the courier at delivery and the package must not be accepted. Damage reported later for products accepted without a report may not be accepted.

 

6. REFUNDS

Once a return is approved, the price is refunded within 14 days at the latest of the withdrawal notice or return request reaching us:

  • For card payments, to the card used for payment

  • For bank transfer/EFT payments, to the IBAN you provide

The time it takes for the refund to appear in your account may vary by bank.
